The Treasurer’s Office will accept tentative inheritance tax payments under Statute 77-2018.07. Any person subject to the tax imposed by sections 77-2001 to 77-2037 may, prior to the final determination of the inheritance tax, make a tentative payment of the tax in order to avoid the accrual of interest or penalty on such tax. Any person who desires to pay such tentative inheritance tax shall make a written application to the county court for an order allowing the payment of a sum specified in such application, prior to the final determination of the inheritance tax due. The tentative tax payment allowed in this section shall apply to both probate and non-probate estates. The tentative tax payment shall not be a final order and may be amended, altered, or modified by subsequent order of the court.

The Treasurer’s Office will accept the Court Order, or other written application to the County Court, or the Inheritance Tax Worksheet that is completed with name of deceased, date of death, book and page number, the tentative amount of inheritance tax due and the required consent of the County Attorney’s Office. If County Attorney will not consent, the Treasurer’s Office will not accept an order which allows the payment of a tentative tax in an amount specified.

If the requested information above is not provided, the Treasurer’s Office cannot take a tentative inheritance tax payment.

Effective Immediately

Going forward, it may take more time to process transactions than you may be used to.  Processing payments may take up to 15 minutes and refunds may take up to 30 minutes.  It will be our new procedure to e-mail you a copy of the receipt upon completion of the transaction so if we have all documentation, you do not have to wait.  We email a receipt to Probate the day that we receive payment for any Inheritance Tax. All Inheritance Tax payments are processed at the 1819 Farnam St. location.

For any Inheritance Tax payments, we will need the following:

  • Signed Order by judge or Signed Worksheet by County Attorney
    • Name of the Deceased
    • Date of Death clearly stated
    • Book and Page number
    • Amount of Inheritance Tax due
  • A phone number on the check
  • Address on the check (or Representative’s physical address)
  • Email address as to where you want your receipt sent

For any Inheritance Tax Refunds, we will need the following:

  • Signed Refund Order – Certified copy
  • Address as to where the refund can be sent (we will need this even if you choose to wait for your refund in our office)
  • Signature of recognition from Representative showing refund has been received or will be mailed
